It is not habitual to speak of two types of sovereignty. Isn't sovereignty the modern norm of political power, as the recurrent use of the expression ‘Sovereign State' implies? Yet when Jean Bodin, a 16th century French jurist, invented this concept, never suspecting how fecund it would become in modernity, another much less known German thinker, Johannes Althusius, who was confronting a very different situation, revisited Bodin's sovereignty attributing it to the ‘organised people'. To sovereignty seen as a material force based on a hierarchical and centralised axis, he opposed a representation of sovereignty as a relational power of a cooperative and federalist nature. Two conceptions of power, of law and of society, had just been revealed, of which modernity would retain only the first. This essay shows how the theory of Althusius questions the saliency of this model by placing a critical distance in relation to some of our beliefs and certitudes about the nature and the finality of the modern political institution.
